Equibase Privacy Notice

This Notice describes how Equibase Company LLC and its subsidiaries and affiliates (“Equibase,” “we,” “us,” or “our”) collects, uses, and discloses personal information about individuals who use our websites (including www.equibase.com, www.trackmaster.com, and any other website that links to this Notice), who download or use our mobile applications, or who otherwise interact with us (collectively, our “Services”).
As used in this Notice, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal information does not include information that is publicly available, deidentified, or anonymized, as defined by applicable privacy legislation.
By using our Services or otherwise providing personal information to us, you agree to our Terms of Use and our privacy practices as described in this Policy.

Personal Information We Collect
Generally, we collect the following categories of personal information. Note that the specific personal information we collect about you may vary depending on the nature of your interactions with us.

  • Identifiers and Personal Records, including your name, address, email address, telephone number, Customer ID, unique personal identifier, online identifier, account name, signature and IP address.
  • Commercial Information, including records of products purchased, obtained, or considered.
  • Internet or Other Electronic Network Activity Information, including browsing history, search history, and information regarding your interactions with our websites or advertisements.
  • Geolocation Data inferred from your device IP address.
  • Audio Data, including audio recordings of customer service calls
  • Professional or Employment-Related Information, including your employer, job title, and similar information when you interact with us on behalf of a business.
  • Inferences about preferences, characteristics, trends, or attitudes.

Sources of Personal Information
Generally, we collect the categories of personal information described above from the following sources:

  • Directly from you
  • From our affiliated companies
  • Automatically through tracking technologies such as through cookies, pixels, and software development kits, and other similar technologies
  • Created by us (for example, if we assign you with a login or develop inferences about you)
  • If you have a business relationship with us, from other companies we do business with, which may include your employer
  • From service providers that help us to run our business
  • From third parties including business partners, advertising networks, social networks, internet service providers, data brokers, and data analytics providers

How We Use Personal Information
Generally, we use the personal information we collect for the following business or commercial purposes:

  • To provide you with our products and services, including fulfilling orders and processing transactions
  • To maintain your accounts with us
  • To provide customer service and support
  • To allow you to use our websites
  • To communicate with you
  • To support our operations, including to improve our products and services through research and analytics
  • To customize and tailor your experience on our websites
  • For marketing and advertising, including to show you relevant ads while you browse the internet or use social media
  • To send you news, updates, and information related to our product offerings
  • To comply with applicable legal requirements
  • For security purposes, including to detect and prevent fraud or other potential harms against you and/or us

How We Disclose Personal Information
We may disclose each of the categories of personal information we collect to our affiliates, service providers, and contractors for the following business purposes:

  • Performing services (including processing, maintaining, or collecting personal information) on our behalf related to the operation of our business (e.g., providing communications, technical, analytical, web hosting, data storage, application support, vendor management, billing, credit card processing, customer support, accounting, auditing, insurance, legal, security, or other services)
  • Auditing related to ad impressions
  • Ensuring security and integrity of personal information
  • Debugging to identify and repair errors that impair existing intended functionality
  • Short-term, transient use, including, but not limited to, non-personalized advertising
  • Providing advertising or marketing services on our behalf
  • Undertaking internal research for technological development and demonstration
  • Undertaking activities to verify or maintain the quality or safety of our Services
  • To comply with applicable laws and regulations
  • For safety and security
  • Detecting, protecting against, or addressing malicious, deceptive, fraudulent, or illegal activity

We may also use and disclose personal information as required by law, regulation or court order; to respond to governmental and/or law enforcement requests; to identify, contact or bring legal action against someone who may be causing injury to or interfering with our (or others’) rights or property; to support any actual or threatened claim, defense or declaration in a case or before any jurisdictional and/or administrative authority, arbitration or mediation panel; or for other purposes described in any other privacy policy or with your consent. Additionally, we may use and disclose personal information to third parties in connection with a sale, assignment, merger, reorganization, or other corporate transaction relating to all or part of our business.

Cookies and Other Tracking Technologies
We, as well as our service providers and third-party partners use a variety of tracking technologies, including cookies, beacons, pixels, and APIs on our websites. Depending on your device and browser settings, these tracking technologies may collect and store your IP address, device identifiers, user preferences, approximate geolocation, the pages you click on, and other browsing information such as the website you visited immediately before ours.

We may use these technologies for various purposes, including to provide functionality for the websites, to keep track of your shopping cart, to help us route traffic between servers, to understand how the websites are performing and how visitors use the websites, to improve features and content on the websites, and for advertising purposes. We also use tracking technologies in some of the emails we send in order to understand whether our messages are received and viewed.

Analytics. We use analytics tools, including Google Analytics, to analyze how you interact with our websites. This software may collect information such as your IP address, location, operating system type, access time, duration of visit, and actions you take on our websites. Google Analytics is owned and controlled by Google LLC. Data collected by Google is subject to its privacy policy. You may opt-out of having your website activity made available to Google Analytics by installing the Google Analytics browser add-on, available here.

Session Replay. We may use third-party services, including Microsoft Clarity, to capture how you use and interact with our websites through behavioral metrics, heatmaps, and session replay. These tools assist us to improve our Services and better understand how people engage with our websites. Online Advertising. Our websites collect information about you in order to target advertisements to you when you browse the internet or use social media. One of the tools we use for this purpose is Google Ads, which is an advertising service provided by Google. Google uses cookies and other identifiers, in combination with their own data, to show you ads based on your usage of our websites. You can personalize the ads you receive or opt out of ads from Google by visiting the Google Ads Settings page. Some of the publishers and vendors that support our advertising may participate in the Digital Advertising Alliance (“DAA”) AdChoices Program and may display an Advertising Option Icon for Interest-based Ads that links to an opt-out tool which allows you to make certain choices regarding targeting. In addition, certain advertising networks and exchanges may participate in the Network Advertising Initiative (“NAI”). Please note that opting out of one or more NAI or DAA members only means that those selected members should no longer deliver certain targeted ads to you, but does not mean you will no longer receive any targeted content and/or ads (e.g., from other ad networks).

Do Not Track. Our websites do not respond to “Do Not Track” signals sent by browsers, mobile devices, or other mechanisms.

Chat Features. We may offer interactive chat features on our websites for customer service purposes. If you chat with us online, we and our service providers may collect, store, and share information, including personal information, you choose to provide during your chat.

Targeted Advertising, Sales, and Sharing of Personal Information
Although we do not sell personal information in exchange for money, some of the ways in which we share personal information for targeted advertising or analytics may be considered “sales” or “sharing” under US state privacy laws. Listed below are the categories of personal information we share for purposes of targeted/cross-context behavioral advertising or otherwise “sell” for non-monetary consideration:

  • Identifiers
  • Personal Records
  • Internet or Other Electronic Network Activity Information
  • Geolocation Data
  • Commercial Information
  • Inferences

The types of third parties to which personal information is sold or shared are third-party advertisers and some analytics vendors. The purposes for which we sell/share this information include: showing you relevant ads while you browse the internet or use social media; marketing, advertising, certain types of analytics, and similar purposes. We do not have actual knowledge that we sell or share the personal information of consumers under 18 years of age. If you would like to opt out, please see the instructions below.

How Long We Keep Personal Information
We keep the categories of personal information described above for as long as necessary for the purposes described in this Notice or as otherwise authorized by law. This generally means holding personal information for as long as one of the following apply: 

  • Your personal information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • Your personal information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the personal information was collected; 
  • The personal information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or 
  • We are otherwise required or permitted to keep your personal information by applicable laws or regulations. 

Where personal information is used for more than one purpose, we will retain it until the purpose with the latest period expires.

Links to Other Sites
For your convenience, our websites contain links to other sites that may be operated by third parties. We are not responsible for the privacy practices or the content of such third-party sites and we encourage you to review the privacy policy of each website that you visit.

Security
At no cost to you, we take commercially reasonable and appropriate steps to protect personal information from loss, misuse and unauthorized access, disclosure, alteration, or destruction. Please keep in mind, however, that there is no such thing as perfect security, and no internet transmission is ever completely secure or error-free.

Children’s Privacy
Our Services are not intended for children, and we do not knowingly collect personal information from anyone under 18. If we become aware that we have collected personal information from a child, we will delete it in accordance with applicable law.

Your Choices
If you sign up to receive emails from us, we may periodically send you emails regarding promotions and offers. You may unsubscribe from promotional email communications by clicking on the “unsubscribe” link found in our emails. If you opt out of our promotional emails, we may still send you email messages related to your account or any products or services you request from us.

You have the option to opt out of communications regarding Equibase products and services. In order to complete this request, please send a written request via e-mail, including your Customer ID to: Equibase Mailing List Removal

You have the option to no longer receive the Equibase Inside Track mailing. In order to complete this request, please send a written request via e-mail, from the e-mail address used at registration to: Inside Track Removal

You have the option to de-activate your Virtual Stable. In order to complete this request, please visit the Virtual Stable Main Page, or send a written request via e-mail, from the e-mail address used for the Virtual Stable, to: De-activate Virtual Stable

US State Privacy Rights
You may have additional privacy rights under the law of the state in which you live. To submit a request relating to your personal information, please contact use our privacy management webform, or call our toll-free number at 800-333-2211. Please note that we may need to authenticate your identity before your request can be processed. For authentication, you will typically be asked to provide 2-3 pieces of personal information that we will match against our records. In some states and for some types of requests, you may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the webform or toll-free number listed above. We will not discriminate against you if you choose to exercise any of your privacy rights.  

Right to Know, Access, and Data Portability. You have the right to confirm whether we are processing your personal information, to access your personal information, and to obtain a copy of your personal information in a portable format. Consumers in Delaware, Maryland, Minnesota, and Oregon may also request that we provide you with information about the categories or specific third parties to which we disclosed personal information. California residents may request to know:

  • The categories of sources from which the personal information was collected
  • Our business or commercial purposes for collecting, selling, or sharing personal information
  • The categories of recipients to which we disclose personal information
  • The categories of personal information that we sold, and for each category identified, the categories of third parties to which we sold that particular category of personal information
  • The categories of personal information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of personal information

Correction. You may have the right to request that we correct inaccuracies in your personal information, taking into account the nature of the personal information and our purposes for processing it.

Deletion. You may have the right to request that we delete your personal information, subject to exceptions. When we process deidentified information, including to satisfy a deletion request, we commit to maintaining and using the information in deidentified form and will not attempt to reidentify the information.

Right to Opt-Out. State privacy laws provide the right to opt out of: (a) targeted advertising and sharing of personal information for cross-context behavioral advertising; (b) sales of personal information; and (c) profiling in furtherance of decisions that produce legal or similarly significant effects concerning your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements. We do not sell personal information in exchange for money or engage in practices that qualify as profiling producing legal or similarly significant effects under applicable state privacy laws. Our uses of Personal Information are not “sales” under Nevada law, but if you would like to be notified if we sell Personal Information under Nevada law in the future, please contact us.

To opt out of targeted advertising and/or non-monetary “sales” of personal information via cookies and other tracking technologies, please click on the “Do Not Sell or Share My Personal Information” link in the website footer and adjust your preferences. If you choose to use the Global Privacy Control (GPC) browser signal, you will be opted out sales, sharing and targeted advertising taking place via tracking technologies. Because we are unable to recognize you across different websites, visiting one of our sites with the signal enabled will have the effect of opting you out for that specific site, but will not impact our other websites. You will need to turn on the opt-out signal for each browser that you use and ensure it is enabled when you visit each of our sites.

Appeals. Sometimes we are unable to process requests relating to your personal information, in which case, your request will be denied. If your privacy rights request has previously been denied by us and you believe we denied it in error, you may appeal for reconsideration of your request using the webform or toll-free number provided above.
Please note that if you make a privacy rights request, we will retain the personal information submitted in connection with your request for recordkeeping purposes.

California’s Shine the Light Law. California residents may request a list of the third parties to which we have disclosed personal information, as defined under California Civil Code Section 1798.83(e) (a/k/a the “Shine the Light Law”), during the preceding calendar year for third-party direct marketing purposes. Changes
We may periodically update this Notice and will notify you by revising the Effective Date at the top of this page. Please refer back to this Notice from time to time to ensure you are aware of our most current privacy practices.
